2.1 The contents and features on the site are intended for personal and non-commercial use (articles, images, illustrations, video clips, audio clips, are collectively referred to as "Content"). Rocheston Press Pvt. Ltd., owns and controls the content, which is protected by copyright. Company or the party credited as the provider of the Content. By accessing the content, the user is abiding by all additional copyright notices, restrictions or information in the service.

2.2 The contents and services are protected by copyright in accordance to Indian and international copyright laws. Distribution, modification, sale, reproduction, sale or display of content or the services (including software) in whole or in part is prohibited (except Section 2.3 in the Terms of Service).

2.3 The user may download or copy the content, and other downloadable content, displayed on the site for personal use only and should maintain all copyright and other notices contained therein. Storing or copying any content without the written permission from Rocheston Press Pvt. Ltd., or the copyright holder identified in the copyright notice of the content is prohibited.

2.4 The content is owned or licensed to Rocheston. The site will not be responsible for delays, inaccuracies, errors or omissions or delivery of content, all or in part published by third parties and any damages arising therefrom.

3. USER GENERATED CONTENT: SUBMISSIONS
3.1 Uploading, distributing or publishing any obscene, libelous, defamatory, pornographic, abusive or illegal material is prohibited on the site. The user agrees not to deliberately "spam" discussions or comments with meaningless or repetitive messages. Be respectful and courteous.

3.2 Only noncommercial use of services are allowed. Publication or distribution of any material containing solicitation of funds, advertising or for goods or services is prohibited without the approval of Rocheston Press Pvt Ltd.

3.3 Submissions to the site: comments, reviews, text, video, audio and photographs (each a "Submission"), may be edited, altered, transmitted or published and displayed by Rocheston Press Pvt. Ltd. The submissions may be included in the RSS feeds, APIs and made available through other formats.

3.4 A user grants a royalty free, sub-licensable license to the submissions, which includes without limitation the right for Rocheston Press Pvt ltd or any third-party it designates to modify, transmit, copy, use, distribute, publicly display in any form of media known now or developed hereafter. Submissions posted by a user is owned by Rocheston Press. Pvt. Ltd., including submissions through third party.

3.5 The user is responsible for the content in the submissions. But, Rocheston does not and cannot review every submission and is not responsible for the content. The site deserves the right to remove, edit and move submissions that are abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable.

3.6 Submission to the site indicated that you are consenting to the display the publication on the site for online and offline promotional uses.

4. USE OF THE SERVICES
4.1 The site may not be accessed or used or take any action that could harm us or a third party. The user may not access parts of the site, which are not authorized for use. 5. REPRESENTATIONS AND WARRANTIES

All downloadable content and services are distributed on an "as is" basis devoid of warranties, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability for a purpose. You acknowledge the use of services at your sole risk.

6. COMMUNICATION BETWEEN ROCHESTON AND USERS
6.1 Rocheston Press Pvt. Ltd. reserves the right to inform the users of changes to service through electronic mail or by displaying the changes in website.

6.2 Rocheston Press Pvt. Ltd. reserves the right to reveal information about the site's usage and demographics. Advertisers and/or licensees on our web site may collect and share personal information on indicating your acceptance.

6.3 Rocheston may send in surveys for feedback on products and services through mail. This obtained information will be used to improve the services offered by the site, and surveys will not be shared with third parties.

8. SOFTWARE LICENSES
8.1 The user shall have no access or rights to proprietary software and related documentations, or any enhancements or modifications that was provided to access the site. Sublicensing, transfer or assigning the licenses granted by Rocheston, or any attempt at transfer, sublicense, or assigning shall be null and void. Copying, distribution, alteration or reverse engineering the works from the software is prohibited.

9. TERMINATION
9.1 Rocheston Press Pvt. Ltd. reserves the right in its sole discretion to terminate, suspend access to all or part of the services for any reason or breach or assignment of Terms of Service.

10. MISCELLANEOUS
10.1 These Terms of Service have been made in and shall be elucidated and enforced in accordance with the Indian law. Any action or breach in the Terms of Service shall be brought in the local or higher courts located in India.

10.2 Regardless of the aforementioned, nothing in these Terms of Service will forestall the promises made in the Rocheston Press Pvt. Ltd privacy policy.

10.3 The user agrees to report copyright violations in the Rocheston website in their knowledge. Any claim of copyright infringement with respect to material in the site can be notified to [email protected]

Rocheston provides this Privacy Policy to explain how it collects, stores, and uses the information collected in connection with Rocheston’s software applications, and websites (collectively, “services”). In some cases, an administrator may create an account in Rocheston on the behalf of a “End-User” and may provide his/her information, including Personal Information. In such cases the administrator who may be your Employer or a Rocheston Authorized Training partner (ATP) is our “Customer.” We collect Information under the direction of our customers and have no direct relationship with the End-User whose personal data we process.

An End-user’s use of the Rocheston platform may be subject to the Customer’s policies, if any.

Our Customer must have the authority to act on behalf of the End-User and to consent to the collection and use of their Personal Information as described in this Privacy Policy.

If you are an End-user using our platform, please direct your privacy inquiries to your administrator. Rocheston is not responsible for the privacy or security practices of our customers, which may differ from those set forth in this privacy statement.

International Transfer


Personal data collected by Rocheston may be stored and processed in your region, and in any other country where Rocheston or its affiliates, data sub-processors operate facilities. To facilitate Rocheston global operations, we may transfer and access such information from around the world, including from other countries in which the Company has operations. A list of the Rocheston’s global offices is available here. This Privacy Statement shall apply even if Rocheston transfers Data to other countries.

Currently, Rocheston and its data sub processors have data centers in United States, and India.

The data we hold may also be processed by employees operating in countries listed above, Such staff may be engaged in, among other things, product development and customer and technical support. The data protection and other laws of these countries might not be as comprehensive as those in your country. By submitting your data and/or using Our Services, You consent to the transfer, storing, and processing of Your data in these countries.

Note to our customers in Europe: We transfer personal data from the European Economic Area and Switzerland to other countries, some of which have not been determined by the European Commission to have an adequate level of data protection. When we do, we use contracts, to help ensure your rights and protections travel with your data. Rocheston uses this Privacy Policy to govern the use of personal information you provide to us. We use your personal information solely to provide our services to you. We also use your Personal Identifiable Information (PII) together with other Personally Non-Identifiable Information (non - PII) to help us better understand our users and to improve the content and functionality of our site.

Note: All payment transactions are processed through secure payment gateway providers. We do not store any card information (other than the last 4 digits of your card) in our servers.

  • Unique Identifiers, such as username, or password;
  • Name and e-mail address when you provide feedback from the Service(s)

We reserve the right to disclose your personal data as required by applicable law, in response to lawful requests by public authorities, including meeting national security or law enforcement requirements and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or other legal process served on us.

In the event Rocheston goes through a business transition, such as a merger or acquisition by another company, or sale of all or a portion of its assets, your user account and personal data will likely be among the assets transferred. You will be notified via email and via a prominent notice on our Websites of any such change in ownership or control. We may also disclose your personal information to any other third party with your prior consent.

Data from Third Parties

  • If you are using an enterprise-provided account (Rocheston Authorized Training Partner or your Employer)

Exceptions in Deletion: If you request access to your personal information and discover that that information is wrong, we strive to give you ways to update it quickly or to delete it – unless we have to keep that information for legitimate business or legal purposes. We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from our services, we may not immediately delete residual copies from our active servers or backup systems.

Exception in Data Portability: There may be limits to the amount of information we can practically provide. For example, we may limit an individual’s access to personal information where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy or where doing so would violate others’ rights.

For Courses:


We agree to keep confidential all the information that comes into its possession regarding the Program’s examinations. If Rocheston is found to have disclosed the content of any of the Open Group’s examination scenarios, questions, or answers to any third party other than in the normal course of Rocheston attendees sitting the examinations, the Agreement and all Schedules attached to it will be immediately terminated and the Open Group shall remove all of the Rocheston’s ATCs and Affiliates from the Accreditation Register.

Children's Personal Information


Rocheston does not knowingly collect any personal information from children under the age of 13. If you are under the age of 13, please do not submit any personal information through our Websites or Service(s). We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide personal information through our Service(s) or Websites without their permission. If you have reason to believe that a child under the age of 13 has provided personal information to us through our Websites or Service(s), please contact us and we will endeavor to delete that information and terminate the child's account from our databases.

Amendments
